DiMA Submits Comments to Department of Justice on Review of ASCAP and BMI Consent Decrees
DiMA Submitted Comments to the United States Department of Justice in response to the public announcement of the review of the Consent Decrees governing Performing Rights Organizations ASCAP and BMI.
DiMA urged the DOJ to move cautiously and to retain oversight over the musical works performance licensing marketplace, pointing out that each individual song is, in effect, a "monopoly" (as no one song can actually be a market substitute for another song) and accordingly, catalogs of musical works do not actually "compete" with one another in the market, like other goods do.
